مقایسه ی قراردادی سازی در حقوق خانواده ایران و فرانسه

چکیده

قراردادی سازی موضوع تامل جاری حقوق فرانسه در مسیر تحول قابل توجه حقوق خانواده است . فردگرایی، اساسی سازی و فاصله گرفتن از نهادگرایی و قواعد آمره منشاء این جریان محسوب می‌شوند. این درحالی است که بسیاری از امور ممنوعه در این مسیر شکسته شده اند . فقط موارد محدودی مثل برخی عناصر احوال شخصیه و نسب قراردادی نشده اند . شناخت صحیح قراردادی‌سازی ، با تشخیص نسبت یک نظام حقوقی با قراردادگرایی میسر خواهد شد. در حقوق فرانسه این نگاه جدی است که قراردادی سازی گرچه در خدمت فرد است اما نهایتا در خدمت جامعه خواهد بود و نوعی تنظیم اجتماعیِ روابط خانواده را رقم خواهد زد. در مقابل، حقوق خانواده ی ایران با توجه به خاستگاه اسلامی خود رابطه ای جدی با قرارداد دارد. اما این رابطه فقط با توجه به مصلحت جامع و قطعی انسان سامان می‌یابد. مصلحت جامع و قطعی انسان عبارت از منفعتی است که هیچ بعدی از ابعاد وجودی انسان را نادیده نگرفته و با تردید آمیخته نباشد و نسبت به آن اطمینان وجود داشته باشد .در این صورت است که منافع فرد و جامعه توامان تامین خواهند شد. شناخت صحیح مرزهای قواعد آمره وصیانت از ظرفیت های آن می‌تواند حقوق ایران را ضمن بهره مندی از قراردادی سازی نسبت به آسیب های این موج حفظ نماید.

Contractualization is the subject of the current reflection of French law on the rapid evolution of family law. Individualism, fundamentalism, and distancing from institutionalism and imperative rules are at the root of this trend. . It is true that many forbidden things have been broken in this way. The correct understanding of contractualization will be possible by recognizing the relationship of a legal system with contractualism. In French law, there is a serious view that contractualism, although in the service of the individual, will ultimately serve society and shape a kind of social regulation of family relations. In contrast, Iranian family law, given its Islamic origins, has a serious relationship with contracts. But this relationship is organized according to the comprehensiveand definite interest of man, in which no dimension of human existence is ignored and mixed with doubt and there is confidence in it. In this case, the interests of both the individual and society will be served. Proper knowledge of the boundaries of the imperative rules and protection of its capabilities can protect Iranian law from the harms of this trend while benefiting from contractualization.
