Financial Technology (FinTech) is a novel concept that, by linking the domains of finance, technology, and innovation, has transformed traditional banking and financial services in various areas. As an example, with the expansion of Peer-to-Peer (P2P) Lending, the role of traditional financial institutions has diminished, and users have found the possibility of direct financing without the need for intermediaries. In legal systems such as the USA and the European Union, through the design of legal frameworks like the Dodd-Frank Act, the PSD2 Directive, and GDPR regulations, support for innovation has been undertaken alongside maintaining user security and financial stability. In contrast, Iranian law largely lacks comprehensive regulations regarding FinTechs, and the existing frameworks do not meet the new needs and are limited to traditional banking models. The present research, using a comparative and descriptive-analytical approach in the field of financial technologies and P2P lending, attempts to offer practical solutions for reforming legal frameworks. The aim is to facilitate the development of financial technologies while adhering to legal and jurisprudential (Sharia) principles. The results of this research indicate that establishing comprehensive legal frameworks is essential. These frameworks should be formulated with the goal of creating a transparent, supportive, and flexible environment for the development and regulation of FinTech activities, ensuring consumer rights, information security, combating money laundering, and supporting innovation. By creating a balance between encouraging innovation, maintaining the stability of the financial system, and protecting user rights, along with strengthening supervision through RegTech (Regulatory Technology), providing for a regulatory sandbox, and ensuring coordination among relevant institutions, these frameworks can help remove obstacles and facilitate innovation and competition for FinTechs in Iran
