راهکارهای جلوگیری از خرد شدن زمین‌های کشاورزی موروثی در حقوق ایران و ترکیه

چکیده

تقسیم زمین کشاورزی در اثر ارث، از جمله مواردی است که سبب می‌شود تا زمین‌های کشاورزی به مرور به قطعات کوچکتر تقسیم شود و قطعات کوچک‌تر و خردتر نیز تغییر کاربری یاید، در حالی که حفظ یکپارچگی زمین‌‌های کشاورزی برای رسیدن به امنیت غذایی و توسعه پایدار یکی از دغدغه‌های قانون‌گذار بوده و قانون‌گذار را در کشور ترکیه بر آن داشته تا برای جلوگیری از خرد شدن اراضی کشاورزی و در نتیجه تغییر کاربری آن قوانین ویژه‌ای وضع کند. قانون‌گذار در ایران نیز قانون جلوگیری از خرد شدن اراضی کشاورزی را به هدف جلوگیری از خرد شدن زمین‌های کشاورزی در اثر ارث وضع کرد، ولی این قانون نتوانست مانع خرد شدن زمین‌های کشاورزی شود و روند تقسیم زمین-های کشاورزی همچنان ادامه دارد. در این نوشتار با استفاده از تجربه کشور ترکیه راهکارهایی متناسب با وضعیت حقوقی ایران ارایه شده است.
قانون‌گذار در ایران نیز قانون جلوگیری از خرد شدن اراضی کشاورزی را به هدف جلوگیری از خرد شدن زمین‌های کشاورزی در اثر ارث وضع کرد، ولی این قانون نتوانست مانع خرد شدن زمین‌های کشاورزی شود و روند تقسیم زمین-های کشاورزی همچنان ادامه دارد. در این نوشتار با استفاده از تجربه کشور ترکیه راهکارهایی متناسب با وضعیت حقوقی ایران ارایه شده است.

چکیده [English]

The division of agricultural land through inheritance is a significant factor contributing to the fragmentation of farmland into smaller plots over time, often resulting in changes in land use. Preserving the integrity of agricultural land is essential for ensuring food security and promoting sustainable development, making it a critical concern for policymakers. In Turkey, legislators have addressed this issue by enacting specific laws to prevent the fragmentation of agricultural land and to restrict changes in its use. Similarly, Iran has implemented legislation aimed at preventing the division of agricultural land through inheritance. However, this law has not achieved its intended objectives, and the subdivision of agricultural land continues. This essay examines Turkey's experience and proposes appropriate legal solutions to improve Iran's approach to preserving agricultural lands. Iran enacted a law to prevent the fragmentation of agricultural lands due to inheritance; however, this law has not achieved the desired goal, and the division of agricultural lands continues. By analyzing Turkey's experience, this essay offers suitable solutions to address Iran's legal challenges in this area.
