تأثیر روش‌شناسی مطالعات تطبیقی در آیین دادرسی مدنی ایران

چکیده

یکی از مشکلات فراروی پژوهشگران مطالعات حقوق تطبیقی، فقدان اجماع برای انتخاب یک روش خاص جهت انجام این مطالعات است. از یک سو، «حقوق تطبیقی» و به‌ویژه «روش‌شناسی آن» علمی جوان و نوپا بوده و در دهه‌های اخیر همواره مورد نقد و تغییرات گسترده قرار گرفته است. از سوی دیگر، تفکیک مطالعه تطبیقی از بررسی بستر تاریخی، اجتماعی و فرهنگی کشورهای مورد مطالعه ممکن نیست. این امر، انتخاب روشی مناسب برای مطالعه تطبیقی را به جهت جنبۀ چندوجهی بودن آن، با دشواری مضاعف مواجه نموده است. در این پژوهش پس از تبیین مفاهیم بنیادین مربوط به روش‌شناسی حقوق تطبیقی، بستر تاریخی و روند شکل‌گیری آیین دادرسی مدنی ایران بررسی شده است. با توجه به نوپابودن موضوع «روش‌شناسی حقوق تطبیقی» به‌طور ویژه و به‌طور کلی نو پدید بودن «حقوق تطبیقی» به‌عنوان رشته‌ای مستقل از سایر رشته‌های مطالعات حقوقی، نظام آیین دادرسی مدنی ایران علی‌رغم تلاش‌های قابل‌ستایش اندیشمندان، نتوانسته است بهره کافی را از مطالعات حقوق تطبیقی، به‌ویژه در حوزۀ نظام قانون‌گذاری آیین دادرسی مدنی برده باشد.

چکیده [English]

One of the challenges encountered by researchers in comparative law studies is the lack of consensus regarding the selection of a specific methodology for conducting these studies. On one hand, “comparative law” and especially “its methodology” is a relatively young and evolving field that has faced numerous criticisms and evolutions in recent decades. On the other hand, it is essential to separate a comparative study from the historical, social, and cultural context of the countries under study, as these factors cannot be separated from a comparative analysis. This complexity has made it difficult to identify an appropriate method for conducting comparative studies due to their multifaceted nature. In this study, we first explain the fundamental concepts related to the methodology of comparative law, the historical context and the development of Iranian civil procedure. Given the nascent nature of the subject of “comparative law methodology” in particular and the recent emergence of “comparative law” as an independent field of legal studies more broadly, the Iranian civil procedure system, despite the commendable efforts of scholars, has not sufficiently from comparative law studies, particularly in the area of the legislative framework of civil procedure law.
