One of the biggest problems that researchers in the field of comparative law studies face when conducting these studies is that there is no consensus to choose a specific method to conduct these studies. On the one hand, "comparative law" and especially the category of "its methodology" is a young and nascent science, and in recent decades it has always been criticized and changed a lot, and on the other hand, the feature of the impossibility of separation and inseparability of comparative law studies from Studies and investigation of the course and historical, social and cultural background of the countries under study, the possibility of adopting a suitable method for these studies due to its multifaceted aspect and in simpler words its interdisciplinary nature, with additional difficulty in conducting research and Finally, it has become possible to use these studies properly; The difficulties that the legal system of our country and especially the field of "civil procedural law" are not exempt from, and in this research, it has been tried to explain the fundamental concepts related to the methodology of comparative law, by examining the historical background and the process of formation of the legal system. The Civil Procedure Code of Iran should pay attention to the fact that due to the nascent nature of the category of "Comparative Law Methodology" in particular and the new emergence of "Comparative Law" as an independent field from other fields of legal studies, the legal system Iran's civil procedure, despite the abundant and commendable efforts of late and advanced doctrines and scholars, has not been able to benefit from comparative law studies, especially in the field of legislation in the field of civil procedure law.
