The use of stem cell technology is a new way to help solving the problems caused by diseases and physical disorders and facilitate in the matter of transplanting organs and repairing damaged tissues. These types of cells are sometimes obtained from the bone marrow of an adult, the umbilical cord, or from the human embryo. Although the benefits of using this technology are very vital and important, due to the subject of its study which is an alive human being, his organs or a human embryo, in many cases it faces ethical, legal and jurisprudential considerations, however, this issue is not addressed in the current law and this has caused different theories to determine its legitimacy or illegitimacy. This research is going to clarify the nature and use of stem cells, and specifying the goals and importance of their use, considering the challenges in the process of obtaining this type of cells and the way they’re used, and comparing the legal status of the use of stem cell technology in two countries of Iran and France. Based on the comparison between the two countries of Iran and France in the use of stem cell technology, it can be said that both Iran and France’s legal systems believe in the necessity of using this technology in medical science, but ethical considerations are the most important factor in determining the scope of the use of stem cell technology.
